Case: Plaintiff was treated by defendant with orthodontic appliances. Plaintiff's upper four front teeth suffered severe root resorbtion. Settlement: $200,000.00.

Case: Defendant failed to recognize the lack of sufficient movement of an impacted canine tooth during the initial 6 months of treatment or that the tooth was fused (ankylosed) to the bone. As a result, severe forces were applied on adjacent teeth resulting in severe misalignment of the jaw. Due to the lack of movement, alternatives should have been discussed including the extraction of the canine and/or the use of a bridge, and in addition, consultation with specialists. Surgery of the jaw (LeForte osteotomy) was required in which the jaw was cut in 3 places. Plaintiff's bite could not be fully corrected and the risk of future tooth loss increased due to the long term stress placed on the teeth. The upper jaw subsequently relapsed to some degree. Plaintiff's bite will remain abnormal to some degree forever. Verdict: $460,000.00.
