Case: Plaintiff presented to defendant dental clinic for a crown and post procedure. During the procedure, plaintiff aspirated the dental post while it was being tried in by defendant's dental assistant. Plaintiff alleged the defendant was negligent in failing to maintain control of the post. Defendant contended that a post being aspirated is a risk of the procedure and that it can occur in the absence of negligence. Plaintiff underwent a lobectomy of the right lung and, suffered substantial pain and anxiety, and was left with residual scarring. Verdict: $177,100.00
Case: Veneer composites were placed on plaintiff's four upper front teeth for esthetics. Plaintiff complained of discomfort, headaches and diffuse face pain. Defendant ground down plaintiff's teeth six times over the next year in an attempt to correct her bite. Plaintiff further suffered from TMJ as a result of defendant's negligence. Settlement: $100,000.00
Case: Placement by defendant dentist of six upper and six lower anterior veneers. Excessive grinding of anterior teeth for veneer placement results in devitalization of nerves in teeth, sensitivity to temperature, chewing and breathing problems. Teeth were ground excessively from a lateral and horizontal standpoint, but had under-prepared them from a vertical standpoint. Settlement: $100,000.00
Case: Defendant dentist performed bridge work in all four quadrants of the mouth. The restorations caused bleeding, swollen gums and infection. Despite x-rays showing ill-fitting crowns, defendant never advised plaintiff that the work needed to be redone. Arbitration Award: $109,500.00
Case: Plaintiff suffered loss of teeth, aggravated gum disease and TMJ dysfunction due to negligent bridgework and over-equilibration of bite. Defendant failed to refer plaintiff to a periodontist before performing any work. The bridge placed did not fit properly. Settlement: $185,000.00
